The Successful Seller Plan

50 Point Marketing Guarantee 

Main Guarantees


  1. WE implement the Successful Seller Plan on behalf of the Seller and property named below.
  2. WE guarantee our services in writing through this document.
  3. WE agree in advance that the Seller may cancel the standard Listing Agreement, of which this Guarantee is made a part, in writing any time before its expiration.
  4. WE purchase for your property a one-year Home Warranty Protection Plan to pass to Buyer Or for you, a Close & Fly appreciation gift at Closing.
  5. WE prepare a full color photo "Property Information Fact Sheet" for your property.
  6. WE place access to your property on the Internet in several places e.g. Realtor.com, Hawaii RE Central, Coco Isle Realty Online.
  7. WE provide you with regular progress reports.
  8. WE stay available to you for consultation, ideas, and advice.
  9. We share the cost of a formal "short form" appraisal if one is needed and if we list the property at not more than 110% of that value.
  10. WE refer you, when you don't already have an agent, to one or more excellent, responsive CRS agents when you relocate away from Oahu.

Marketing Details


  1. WE conduct a Home Enhancement Review upon taking the listing.
  2. WE analyze local & national trends & strategies for selling at top dollar in the period you specify, taking into account the property's special features.
  3. WE prepare a written marketing plan tailored to fit your property, intended to fit your goals, and outlined as to various strategies.
  4. WE market your property vigorously through the many complementary approaches available in real estate marketing.
  5. WE advertise your property regularly in print and other media.
  6. WE distribute numerous copies of the property's color fact sheet.
  7. WE target the special classes of CRS and CCIM Realtors (who are tops in the residential and investment real estate fields) for their buyers.
  8. WE alert 100% of Realtors (brokers) & Realtor-Associates (sales people) on Oahu, and specifically target those in the top 5% of earned sales income.
  9. WE contact, with your permission, 50 of your friends, associates, and acquaintances from a network list you may want to prepare for us.
  10. WE hold one or more public open houses by arrangement with the tenant or occupant (Sunday or by arrangement).
  11. WE hold one or more "Brokers' Open" open houses in mid-week.
  12. WE invite the neighbors to our first public Open House.
  13. WE invite all Oahu agents to a special Broker's Open House.
  14. WE send out Just Listed notices, Open House notices, and color fact sheets for your property as appropriate and to whom appropriate.
  15. WE post alert notices on bulletin boards in condos, supermarkets, etc.
  16. WE post a "For Sale" sign on the property if permitted.
  17. WE set up "showing appointments" for viewing by buyers and agents.
  18. WE respect the rights of tenants and occupants of the property.
  19. WE market your property directly to local and non-local buyers, to local agents with buyers, and to national & international buyer networks.
  20. WE place the property in the MLS (Multiple Listing Service) computer database from which the thick MLS book is published twice monthly.
  21. WE find professionals for you when needed in activities beyond the scope of our license or business (contractors, attorneys, lenders, etc.).
  22. WE use the latest technology.

Contracts, Escrows, & Follow Up


  1. WE negotiate beneficial "win-win" arrangements for buyer and seller.
  2. WE review with you and prepare you for the content of the many and detailed forms used in a typical real estate transaction.
  3. WE present all written offers to you.
  4. WE review each offer with you, analyzing merits, deficiencies, and possible scenarios; we give you recommendations & suggest responses.
  5. WE discuss with you Hawaii state real estate laws regarding disclosure, FIRPTA, HARPTA, Civil Rights Laws, and other areas as needed.
  6. WE provide an itemized estimate of your expected proceeds at various prices, and just what your reasonable costs should be, keeping them to a minimum wherever and whenever possible.
  7. WE get written evidence of cash in advance when a buyer is purchasing "all cash" and do not rely upon verbal representations.
  8. WE make sure that you receive a credit report when there is Seller financing by way of an Agreement of Sale or Purchase Money Mortgage.
  9. WE make sure the buyer is pre-qualified in writing by a lender or mortgage broker before you accept an offer to purchase involving a loan.
  10. WE take steps that a signed sales contract is not "assignable" to another party without your written approval.
  11. WE coordinate and oversee escrow for the sale of the property.
  12. WE handle details to make the transaction go through, and order disclosures and various legal and other reports as required or helpful.
  13. WE coordinate both escrows if seller is also purchasing another property or doing an IRS tax deferred 1031 or other exchange.
  14. WE order the survey, termite report, and other inspections as needed.
  15. WE provide before closing a preliminary estimate of closing costs and proceeds based on the actual sales contract, making sure they are accurate.
  16. WE meet with you in our office, at your residence, and/or at the escrow office if you are in Hawaii at the various stages of the purchase and for formal signing; we answer or find answers to your questions at all times and solve various problems that may come up. If you are off-island, we handle important details of the purchase process by telephone, fax, express mail, or any means necessary to ensure the transaction goes as intended.
  17. WE make sure your proceeds are delivered to you immediately in the form you want & to the place or account you've specified -- and we follow up!

The standard listing marketing agreement is for 12 months.


Dear Seller: The Successful Seller Plan enhances the marketing and salability of a property in a period specified by the Seller. A Seller may cancel the standard Listing--Marketing Agreement, of which this Guarantee is made a part, in writing at any time. James Patton, (Realtor, Broker, CRS) through Coco Isle Realty,  guarantees his services and activities relating to the marketing and sale of the below named property. Many of these activities and services are itemized above. James Patton has so much confidence in the Home Warranty as a tool a seller should employ that, for the sole purpose of enhancing the marketability of your property, James Patton agrees to purchase a standard Home Warranty for your property transferable to the buyer at Closing as a 12 month benefit; instead, Seller may opt to participate, as a gift from James Patton, in Coco Isle Realty's Close & Fly program. -- James Patton
